This Privacy Notice should be read together with any additional privacy information we provide for specific activities, such as competitions, promotions, events, surveys, advertising enquiries or recruitment.

The personal data we collect depends on how you interact with Energy 106.

Your name, email address, phone number, postal address and any details you include in messages to us.

Studio messages and listener interaction
Messages, WhatsApp messages, SMS messages, emails, voice notes, shout-outs, requests, dedications, comments, opinions, social media messages, audio clips and competition entries.

Club Energy newsletter details
Your email address and any optional details you choose to provide, such as your name, preferences, interests or location.

Competition and promotion details
Information needed to run competitions and promotions, verify eligibility, contact entrants, select winners and deliver prizes. This may include name, contact details, age or date of birth, address, entry details, answers, eligibility information and prize delivery details.

Advertising and business enquiries
Your name, business name, job title, contact details, campaign information, billing or payment-related information, and correspondence.

Complaints and rights requests
Information you provide when making a complaint, privacy request or enquiry, including identity verification information where needed.

Images, audio and video
Photos, audio, video or other content you provide to us or that is captured when you take part in a programme, competition, event, promotion or publicity activity.

To produce radio programming and listener interaction

This includes reading out messages, playing voice notes, using shout-outs, responding to requests, selecting listener contributions and creating programme content.

Lawful basis: legitimate interests in producing interactive radio content and engaging with listeners.

To run competitions, prize draws and promotions

This includes receiving entries, verifying eligibility, selecting winners, contacting winners, delivering prizes, preventing fraud and keeping records.

Lawful basis: contract; legitimate interests in running fair promotions; legal obligation where we need to comply with applicable rules or laws.

To send Club Energy newsletters and marketing emails

This includes updates, events, competitions, offers and station news.

Lawful basis: consent, where required. You can withdraw consent at any time.

To improve our website, streaming and services

This includes analytics, troubleshooting, performance measurement, testing, service improvement and understanding how people use our services.

Lawful basis: legitimate interests for essential service improvement and security; consent for non-essential cookies, analytics or similar technologies where required.

To keep our services secure and prevent misuse

This includes detecting abuse, spam, fraud, unauthorised access, malicious activity and technical problems.

4. Studio messages, voice notes and on-air use

If you send messages, voice notes, dedications, requests or other content to Energy 106, including by WhatsApp, SMS, email, social media or app, we may:

  • read them out on air;
  • play them on air;
  • edit them for timing, clarity, compliance or production reasons;
  • use them in programme content;
  • use them on our website or social media; and/or
  • keep a record for production, compliance or administrative purposes.

We do this because you have chosen to contact a radio station for interaction or content, and listener interaction is part of producing live and recorded programming.

Please do not send us anything you do not want potentially broadcast or published.

If you want content removed from online use, contact us using the details in section 1. We will consider reasonable requests, but we cannot usually remove something that has already been broadcast live.


5. Club Energy newsletter preferences

You can opt out of Club Energy emails at any time by:

  • using the unsubscribe link in any newsletter email; or
  • emailing info@energy106.co.uk with “Privacy” in the subject line.

If you unsubscribe, we may keep a minimal suppression record so we do not email you again.


6. Competitions and promotions

When you enter a competition or promotion, we may use your personal data to:

  • process your entry;
  • verify eligibility;
  • contact you if you win;
  • announce or publish limited winner information;
  • deliver or arrange delivery of prizes;
  • prevent fraud or abuse;
  • handle queries or complaints; and
  • comply with legal, regulatory and advertising rules.

Where a competition involves an advertiser, sponsor, prize provider or partner, we may share necessary personal data with them so the competition can be administered and prizes can be fulfilled.

Ofcom, ASA, ICO, courts, law enforcement, government bodies or other authorities where required by law, regulation or to protect our rights.

Business changes
Potential buyers, investors, funders or advisers if we restructure, sell or transfer all or part of our business.

We require service providers acting as processors to protect personal data and use it only for agreed purposes.

Some suppliers, platforms and service providers may process personal data outside the UK.

General enquiries and listener messages
Kept for as long as needed to respond and manage the communication, then retained for a reasonable period for administrative, complaint-handling or evidential purposes.

Advertising and business enquiries
Kept for as long as needed to manage the relationship, campaign or enquiry, and then for legal, accounting, tax or dispute purposes where required.

Club Energy newsletter data
Kept until you unsubscribe or we stop operating the mailing list. We may keep a minimal suppression record after you unsubscribe.

Studio messages and production content
Kept as needed for broadcast, production, administration, compliance and archive purposes.

Broadcast recordings
Kept in line with our broadcast compliance obligations and internal policies. We usually keep recordings of broadcast output for at least 42 days after transmission.

Competitions and promotions
Kept long enough to run the competition, verify entries, select and contact winners, deliver prizes, handle complaints, comply with advertising rules and maintain audit records.

Complaints and privacy rights requests
Kept for as long as needed to investigate and respond, and then retained where necessary for legal, regulatory or evidential purposes.

Website analytics and cookie data
Kept for the period stated in our cookie banner, cookie settings or cookie information, where applicable.

We may keep information for longer if required by law, regulator, dispute, investigation, insurance, tax, accounting or legitimate business need.
